Return Policy and Right of Withdrawal
This document governs the rights and obligations of the contracting parties arising from the right to withdraw from the purchase contract and the rights from defective performance (complaints) when purchasing goods in the online store Little Dressagerider.
1. Withdrawal from the Purchase Contract (Standard Return of Goods)
In accordance with the provisions of Section 1829 (1) of the Civil Code, the buyer (consumer) has the right to withdraw from the purchase contract without stating a reason within 14 days from the date of receipt of the goods.
-
Costs of returning goods: In the event of withdrawal from the contract within this statutory period, the buyer bears the direct costs associated with returning the goods to the seller.
-
Condition of returned goods and diminished value: The buyer is liable to the seller for the reduction in the value of the goods resulting from handling these goods differently than is necessary to become familiar with their nature, properties, and functionality (standard try-on). For a full refund of the purchase price, the goods must be unworn, unwashed, undamaged, and provided with the original identification tags and labels.
-
Withdrawal procedure: 1. The buyer informs the seller of their decision to withdraw from the contract via e-mail at eshop@littledressagerider.com. (The withdrawal form provided below can be used for this purpose). 2. The buyer shall send the goods without undue delay, no later than 14 days from the withdrawal from the contract, to the following address: Little Dressage Rider, Jílovská 431/23, 142 00, Prague 4, Czech Republic. 3. The seller shall return the received funds to the buyer without undue delay, no later than 14 days from the withdrawal from the contract, but not before the buyer hands over the goods to them or proves that the goods have been dispatched to the seller.
2. Contractual Exchange of Goods (Beyond Legal Obligations)
The seller offers the buyer the option of exchanging unused goods (e.g., for a different size) within 14 days of receipt. In this case, the seller provides the buyer with a premium service by covering the costs of return shipping.
-
Exchange procedure:
-
The buyer contacts the seller via e-mail at eshop@littledressagerider.com with a request to exchange the size/goods.
-
The seller will immediately send the buyer an electronic prepaid shipping label for the free return of the goods.
-
Upon delivery and inspection of the condition of the original goods (they must meet the conditions of unworn goods as per point 1), the seller will immediately dispatch the new goods.
-
3. Rights from Defective Performance (Complaints)
The rights and obligations of the contracting parties regarding the rights from defective performance are governed by the relevant generally binding regulations (in particular the provisions of Sections 1914 to 1925, Sections 2099 to 2117, and Sections 2161 to 2174 of the Civil Code).
-
Quality upon receipt: The seller is liable to the buyer that the item is free of defects upon receipt. The buyer is entitled to exercise the right arising from a defect that occurs in consumer goods within 24 months from receipt.
-
Exceptions: The right from defective performance does not belong to the buyer if they caused the defect themselves (e.g., by improper maintenance contrary to the product label) or if it is normal wear and tear of the item caused by its usual use.
-
Costs of complaints: In the event of a justified complaint, the buyer has the right to reimbursement of purposely incurred costs associated with exercising their right. To facilitate this process, the seller provides a prepaid shipping label for sending the claimed goods.
-
Method of settling the complaint: 1. The buyer notifies the seller of the defect via e-mail at eshop@littledressagerider.com (we strongly recommend attaching photo documentation) and the seller will send them a prepaid shipping label for sending the goods back. 2. Depending on the nature of the defect, the buyer has the right to have the defect removed (repair, delivery of a new item without defects), to a reasonable discount on the purchase price, or (if it is a material breach of contract) the right to withdraw from the contract. 3. The complaint, including the removal of the defect, must be settled without undue delay, no later than 30 days from the date the complaint was raised, unless the seller and the buyer agree on a longer period.
